1. Platform Access

DriverEats grants you a non-exclusive license to use the DriverEats platform to receive and fulfill delivery orders from customers. There is no setup fee or onboarding fee. Monthly platform access is available on the plans described below.

2. Fee Structure — Clear and Simple

Per-Dispatch ($0/mo): No monthly fee. A per-order clearing fee (currently 10% of the food subtotal) applies per delivery order dispatched to DriverEats drivers; your rate is fixed at signup and is never raised on you. About a third of GrubHub/DoorDash top-tier rates, with no 25–30% tier. A flat monthly Membership plan (with a $0 per-order clearing fee) is also available for high-volume partners.
Founding Partner Badge: The first 10 restaurant partners earn permanent Founding Partner status and recognition (the badge). The badge does not include a per-order fee discount and never expires.
Self-Delivery Rate: Orders you fulfill with your own delivery staff under Section 6A carry a clearing fee that is capped at your locked Per-Dispatch rate and will never exceed it (currently 10% of the food subtotal), and may be set lower than your locked rate at DriverEats' discretion.
POS Only (monthly rental, priced at signup): Standalone point-of-sale (dine-in, takeout, bar tabs, KDS). No delivery platform integration; card processing runs on your own Stripe account at Stripe's rates.

DriverEats does not charge setup fees, marketing fees, menu markups, or hidden fees beyond your selected plan, and does not charge you card-processing fees on delivery orders. If a driver waits more than 15 minutes beyond your stated ready time, a $2.00 hold-time fee may be applied to your account per occurrence.

3. Menu Pricing Standards

Because DriverEats' clearing fee is low and there are no required menu markups, there is no reason to raise delivery prices above your in-store prices. You agree that your DriverEats menu prices will not exceed your standard in-store prices by more than 5% for any item. DriverEats monitors this automatically by comparing your menu to publicly available pricing and your own website.

If a discrepancy is found: (1) you receive a private email notice, (2) you have 7 days to correct it, (3) if uncorrected, your tier may be downgraded. Legitimate price increases that apply equally in-store and on DriverEats are always accepted.

4. Stripe Connect

You retain your own Stripe account and are the merchant of record for your orders. On delivery orders, the customer's card is charged on your own Stripe account and the food subtotal (net of the per-order clearing fee on the Per-Dispatch plan) lands directly in your Stripe account at order completion — same day, every order. DriverEats never holds your funds.

6. Order Fulfillment

You agree to: (a) prepare orders with reasonable care and accuracy; (b) maintain food safety standards; (c) mark orders ready for pickup promptly; (d) communicate estimated prep times via the platform.

6A. Self-Delivery (Your Own Drivers)

If you enable Self-Delivery in your portal settings, orders within the delivery radius you set are fulfilled by your own delivery personnel rather than DriverEats drivers. For those orders: (a) your delivery personnel are your employees or agents — not DriverEats contractors — and you are solely responsible for their hiring, wages, supervision, licensing, vehicle insurance, and conduct; (b) you are responsible for the order from preparation through hand-off to the customer, including food safety in transit, delivery timeliness, and compliance with all applicable laws (including alcohol delivery laws, where permitted); (c) the customer-facing delivery fee you set, and 100% of customer tips on those orders, are paid to you via your Stripe account and belong entirely to you and your personnel — DriverEats takes no portion of either; (d) you must maintain auto liability insurance covering your delivery operations as required by law; (e) marking an order "delivered" in the platform is your representation that it was actually delivered to the customer, and charges disputed on orders you delivered may be recovered from you consistent with Section 2 and your monthly statement; and (f) DriverEats acts solely as the marketplace and payment facilitator for these orders. You may disable Self-Delivery at any time, and orders beyond your radius are always fulfilled by DriverEats drivers.

7. Refund & Error Billing

When a customer receives an incorrect, missing, or poor-quality item due to a restaurant preparation error, the cost of the refund or credit may be billed to the restaurant. DriverEats tracks error rates on a monthly basis:
  • 1–2 errors/month: No action
  • 3–5 errors/month: Noted on your monthly invoice
  • 6–10 errors/month: DriverEats contacts you to discuss improvements
  • 11+ errors/month: Account review; continued partnership evaluated

Refunds due to delivery issues (driver late, dropped order) are not billed to restaurants. Only errors attributable to kitchen preparation are tracked and billed. On Self-Delivery orders (Section 6A), disputed charges are handled per that section instead.

8. Performance Standards

To maintain active partner status, restaurants should:
  • Maintain an average customer rating of 3.5 stars or higher
  • Keep order accuracy above 95%
  • Set realistic prep times and honor them consistently
  • Respond to support escalations within 24 hours

9. Customer Data

Customer name and delivery address provided per order are for fulfillment purposes only. You may not use customer data for marketing, solicitation, or any purpose unrelated to the specific order. Customer email and phone numbers are not shared with restaurants — if a customer requests direct contact, they must initiate through DriverEats support. We do not sell your restaurant, menu, or sales data to third parties or competitors.

10. POS Integration

The DriverEats POS system runs on your own Stripe account — in-store card payments are processed at Stripe's standard rates with no DriverEats percentage, and cash payments carry no fee.

11. Termination

Either party may terminate this agreement with 30 days written notice. DriverEats may terminate immediately for fraud, repeated food safety violations, sustained poor performance impacting customer safety, persistent order accuracy failures, or failure to maintain required health department permits. Upon termination, your Stripe account and earnings remain entirely yours.

12. Governing Law

This agreement is governed by the laws of the State of Arkansas. Disputes shall be resolved by binding arbitration in Benton County, Arkansas.
